"DOJ'S Own Study Shows that Bush/Ashcroft Failing to Enforce the Gun Laws"

Washington, DC - Americans for Gun Safety Foundation (AGSF) President Jonathan Cowan issued the following statement on the new Department of Justice, Bureau of Justice Statistics report on background checks for firearms transfers in 2002.

"The Department of Justice has found that in 2002, the National Instant Background Check system rejected 136,000 prospective gun buyers because they failed their background checks. That means that 136,000 felons, domestic abusers, fugitives from justice, and other prohibited gun buyers committed the federal crime of lying on their background check form in an attempt to purchase a gun.

"That number is not surprising -- the rejection rate has been around 150,000 for the past several years. What is shocking is that the Department of Justice is doing so little to prosecute this crime. As AGSF reported in May (after obtaining DOJ data), in the same year that 136,000 people committed the crime of "lie and buy," fewer than 600 people were prosecuted. That means about 99.5% of those who violated this law were let off the hook.

"Make no mistake -- this is a serious crime. After all, it usually involves criminals attempting to arm themselves. President Bush and Attorney General Ashcroft promised to enforce the gun laws on the books, and this report is further evidence that they are breaking the biggest promise that they made on guns."

"Michael Lara bought a Glock handgun last November 21st for a friend of his who manages an apartment complex. The woman has an Arizona concealed weapons permit."

"The woman paid for most of the purchase. Lara showed the woman how to use the gun, clean it, etc."

"When police busted the woman's nephew for marijuana possession, they found the gun and decided to prosecute Lara because he paid for some of the cost of the gun." ...

"One group, Twin Cities Million Moms, has taken up the fight on a related issue repealing the recently passed conceal and carry bill. We just think that this law is devastating, said Kate Havelin. The bill is called conceal and carry, but you dont have to conceal the gun. [Actually it's the MN Personal Protection Act; journalists mislabeled it.] The state estimates that in three years there will be 900,000 total [try 90,000]people who have guns in Minnesota [because of the bill]. And right now there are about 11,000.

A 15-year-old faces charges after a gun was found inside his book-bag at Beecher High School.

The ninth-grader pleaded innocent Thursday to a charge of carrying a concealed weapon in a weapons-free school zone.

Police went to the school about 10 a.m. after being called by school officials who received an anonymous tip.

"It was basically an anonymous tip from someone believed to be a parent who said that her child had seen a gun on this kid in school," Detective Sgt. Scott McKenna said.

Officers found a pistol in the teen's bag, along with a loaded clip that was not in the gun, The Flint Journal reported.

If you have a tough time keeping it straight ... the difference between a benefit and a feature, start a sentence with, "A benefit of liberty is..." You would not complete that sentence by saying limited government, because someone will ask "how does limited government help me?" Obviously, it is better to say, "A benefit of liberty is personal freedom which would allow you to do what you wish as long as you don't harm others. "Eight hours of firearms safety training is mandatory for those seeking a permit to carry concealed guns under Missouri's new law, but some are concerned this is not enough."

"The law mandates the curriculum for the course and that it must be taught 'by an instructor certified by a state or federal law enforcement agency or the National Rifle Association.' "

"There have been indications already that the Law Enforcement Academy at Mineral Area College will offer such a course but probably not until November. Its firearms instructors are certified by P.O.S.T, a branch of the Missouri Department of Public Safety that regulates police training qualifications throughout the state." ...

Senate President Doug White, speaking in March 2003 to the US Sportsmen Alliance, said:

"I am a strong proponent of the right to carry. I absolutely and totally, to the bottom of my soul, understand the rights of law-abiding citizens."

TODAY: His words about HB12 were far different than his deeds. Under Senator White's leadership, the bill was filled with poison pill amendments, the most egregious of which would prevent families from protecting their children in a personal vehicle.

WASHINGTON -- "New Jersey's U.S. attorney told Congress yesterday that violent street gangs represent a growing public threat and must be attacked with the same force and methods used against traditional organized crime families."

"Christopher Christie's appearance before the Senate Judiciary Committee came as his office in Newark announced charges against an East Orange man they said helped provide firearms to gang members in Newark and other parts of Essex County."

"Christie said street gangs in New Jersey, including the Lex Mob, the Elvis Irizarry Crew, the Double II Bloods and the James Bond Gang, are 'structured and sophisticated criminal operations.' " ...

Since this "U.S. attorney" knows how dangerous these street gangs are, will he now support lawful, decent people's right to protect themselves on the very streets in question?

OMAHA, Neb. -- "Amid the prayers and concern among Omaha police officers for their colleague, Officer Jason Pratt, there is frustration. Pratt was shot in the line of duty Sept. 11. Albert Rucker, 21, is suspected of firing the bullet that hit Pratt."

"Officer Scott Beran tells KETV NewsWatch 7, he believes too many felons are given too many chances, and that puts police at risk."

"Beran shot Brian Swotek in July. Swotek had a federal warrant for drug and gun charges, and another warrant for skipping out on drug treatment. Officers knew Swotek's record when, acting on a tip, they arrived at a south Omaha home to serve a warrant. Beran, a six-year veteran on the force, fired three shots at Brian Swotek, 30, on July 20, two of which struck him. Swotek died of the injuries."

"Beran is tired of the judicial system that allowed Swotek (pictured, left) and Rucker to roam the streets." ...

"Gibbons initially had opposed the bill. His switch last week to support the measure allowed the Legislature to override Gov. Bob Holden's veto of the bill, which now takes effect Oct. 11."

" 'We're people who are angry,' said vigil participant Terrance Barber, who noted that about 70 percent of the voters in Gibbons' district had opposed a similar proposal defeated in a 1999 statewide vote." ...

The national handgun buy-back moves to Wodonga this afternoon.

It follows new bans introduced after a shooting at Melbourne's Monash University in October last year.

The Superintendent of the Victorian police licensing services branch, David Dettman, says some shooters are unhappy about handing in their guns. [emphasis added]

"Shooters in general are ordinary people like you and I...they don't have to like it and they certainly don't in a lot of the circumstances, but they realise that the law is there and it's made by Parliament for the community and they certainly don't want to break the law, so they comply," he said.
