He added that he probably wouldn't have survived if not for his young son. Beierman said Owen used his hunting rifle to shoot and kill the bruin. {emphasis added}

I was flat on my back and could feel the bullet going through the bear, Beierman said. Owen was a hero. He shot that bear and killed it on top of me.

No charges will be filed against the man who police said shot and killed two men at Eastern Market following a Detroit Lions game Sunday after the Wayne County prosecutor determined the shot was fired in self-defense.

Investigators found the 40-year-old who fired one shot that killed Jalen Welch, 25, and Rayshawn Palmer, 40, both of Detroit, acted in "lawful self-defense," said Wayne County Prosecutor Kym Worthy in a news release Wednesday afternoon.

We have reviewed this case thoroughly and this is a case of lawful self-defense," Worthy said.

Vice President Kamala Harris, a self-described gun owner, told Oprah in a live-streamed interview Thursday that she is not afraid to shoot someone in self-defense.

If somebody breaks in my house, theyre getting shot, Harris said. Laughing, she continued: I probably should not have said that, my staff will deal with that later.

Ed.: Remember: don't take self-defense advice from democratic candidates. Just because someone breaks in doesn't necessarily mean you can shoot them. Generally, Castle Doctrine grants the *presumption* that deadly force is justified, but that presumption may be be rebutted in court. Know your state laws, and consult competent legal counsel.

A celebration of gun rights outside the Capitol Thursday brought together people who believe their right to bear arms is in danger.

The Vice President of the Second Amendment March, Brian Jeffs said Thursdays gathering is a way for advocates to show support and raise awareness.

Its really a celebration of gun rights and to let people know that there are people that support the Second Amendment, Jeffs said.

They also rallied at the Capitol Thursday to oppose some of Michigans new gun laws that were enacted in February this year.

Rep. Stefanik also called attention to the Second Amendment rights of people living in states with strict regulations, like New York. She said that this bill, the Modern Firearm Safety Act would ban implementing handgun rosters, aligning with a federal court that found Californias handgun roster requirements unconstitutional.

I am proud to introduce the Modern Firearm Safety Act to put a stop to the unconstitutional gun-grabbing agenda pushed on law-abiding American citizens, she said in a written statement in August. My legislation would ban Albany Democrats from imposing illegal handgun roster requirements meant to deter gun ownership.

The ruling, which found the law prevented "law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms," led to thousands of applications for concealed carry permits on Long Island.

Figures Newsday obtained from the Nassau County Police Department, Suffolk County Police Department and Suffolk County Sheriff's Office show that since the ruling, the three law enforcement agencies in charge of the process have approved 17,162 concealed carry gun permits.

The federal firearm buyback program has cost taxpayers nearly $67.2 million since it was announced in 2020, but it still hasn't collected a single gun.

The program is designed to compensate owners of assault-style firearms that were banned by the Liberal government in 2020(opens in a new tab). Although many details of the program still haven't been revealed after four years, businesses and gun owners only have until the end of October 2025 to turn in, deactivate or dispose of outlawed weapons. The government estimates there are 150,000 prohibited assault-style firearms(opens in a new tab) in the country.

Todays opponents of efforts to quell gun violence with regulation often hand-wave toward US historythe Founding Fathers, the Second Amendmentto bolster their case. And that can be persuasive, if its unchecked.

Checking it is what Robert Spitzer does. Hes adjunct professor at College of William and Mary School of Law, and professor emeritus of political science at SUNY Cortland. People gathered on the lawn of the state Capitol Thursday to celebrate the Second Amendment.

Many were carrying guns and exercising their right to bear arms. It was all part of the Second Amendment March put on by Michigan Open Carry. People at the event, like State Representative Angela Rigas, said they want the government to stay away from their gun rights.

They say over the past couple of years that hasnt been happening.

We always will defend our Second Amendment, without it we have no country, Rigas said.

The group "Second Amendment March" believes that the upcoming presidential election is especially important for gun owners as Republican nominee former President Donald Trump and Democratic nominee Vice President Kamala Harris have different views on guns and the Second Amendment.

Vice President Kamala Harris is a gun owner. Apparently that fact is supposed to make other gun owners less leery of her stance on Second Amendment issues.

Theres just one problem. Harris is a gun owner whos also currently an integral part of the most anti-gun administration in American history.

As President Joe Bidens right-hand woman on gun control, shes helped orchestrate a four-year war on the Second Amendment, including through unprecedented efforts to weaponize the Bureau of Alcohol, Tobacco, Firearms, and Explosives against the peaceable gun owners whose trust shes trying so desperately to garner.

In district court, Medina-Cantu requested charges be dismissed on grounds that Section 922(g)(5) violates the Second Amendment, a protection he claims entitlement to, unlike the laws that he did not believe applied to him in the first place. Isnt it funny how that works? District Court Judge Gonzales Ramos didnt find it amusing, however, rejecting the request in light of precedent set in Portillo-Munoz, where in 2011 the Fifth Circuit upheld Section 922(g)(5)(A), reasoning that the people referred to by the Second Amendment did not include those having illegally entered the United States.

The brief, filed with the Court of Appeals for the Sixth Circuit, can be viewed at firearmspolicy.org/mccrumb.

Public schools may not violate the First Amendment rights of their students because they dont like the Second Amendment and protected weapons like Americas Rifle, the AR-15.

On September 9, 2024, the Massachusetts Supreme Court held oral arguments in the cases of Commonwealth v Donnell. Another similar case in which a New Hampshire citizen worked in Massachusetts, Marquis, was consolidated with the Donnell case. Both cases involve New Hampshire citizens who had firearms in their automobiles in Massachusetts

The case concerns whether Massachusetts can impose undue burdens on people from out of state who can legally carry weapons in their home state. It appears the court has received all the arguments in this case and will now consider them and file an opinion and order.

The 2024 Fight Over Guns Has Stagnated

The presidential campaigns debate over gun policy and the emphasis (or lack thereof) on it is unlikely to change from this point through November.

Over the past month, weve seen a high-profile mass shooting and a second assassination attempt against Donald Trump. Weve also seen Kamala Harris give an extended interview on gun policy. Yet, there hasnt been any movement on guns from either candidate, and Americans havent moved the issue up their priority list.

The race has stagnated and, barring an extreme event, will probably stay right where it is on guns.

In 2016, Alaska fishing guide Phil Shoemaker used a 9 mm pistol to kill a gigantic brown bear that was threatening two clients. The 9 mm is generally regarded as too puny for bears.

On the flip side, there have been stories through the years of enraged grizzlies absorbing several hits from high-powered rifles before finally dying.

So, the ultimate answer might be it depends on other factors besides the type of weapon used, like shot placement, bullet type and numerous other factors.

A Dallas County District Court struck down on Thursday Texas Attorney General Ken Paxton's request to temporarily block the State Fair of Texas' new policy banning all firearms from its fairgrounds.

After a two-hour hearing in the District Court, Judge Emily Tobolowsky agreed with state fair officials that they could enforce a gun ban as a private nonprofit.

Last month, Paxton sued the city of Dallas and state fair officials over the new policy. Texas lawmakers also signed a petition pressuring State Fair officials to rescind it, saying the new policy makes the fair less safe.

A Michigan prosecutor said a concealed carrier who killed two people with one shot at a Detroit Lions fan tailgate Sunday acted in self-defense and won't be charged.

Cellphone video captured a fight at the Eastern Market during which the assailant, Jalen Welch, allegedly pulled a gun and threatened a 40-year-old man, WJBK-TV reported. That 40-year-old, a legal concealed pistol owner, fatally wounded Welch with one shot through his head, the station said and that same shot also fatally wounded innocent bystander RayShawn Palmer, who also was hit in the head.

In the early hours of Wednesday morning, an intruder was shot and killed in what appears to be a case of justified self-defense at a vacant home in Berkeley County, West Virginia.

Michael Marshall, a resident of Inwood, called 911 at 3:46 a.m. to report that he had shot a man who had broken into his mothers unoccupied house on Winchester Avenue. Berkeley County Sheriffs deputies arrived quickly and discovered the intruder, later identified as 38-year-old Joshua Boone from Williamsport, Maryland, lying face down in the garage with a gunshot wound.

At the heart of the 2nd case, Carlin Anderson vs. Kwame Raoul is the legal conflict of Illinois ban on suppressorsa critical piece of legislation that has ignited passionate debates about its constitutionality. The implications of this case extend far beyond state lines, with the potential to set a precedent in suppressor regulation across the country. U.S. District Court Judge Stephen McGlynns courtroom has become a pivotal battleground in determining whether these firearms accessories, often demonized by big Hollywood and anti-gun advocates, fall under the protection of the Second Amendment.

Ed.: No. The judge declined to issue an injuction, so the ban stands, for now.

This ruling protecting the State Fair's lame duck policy of not allowing law abiding citizens to carry a firearm during the Texas State Fair is a temporary setback that we feel will be overshadowed this upcoming legislative session by the dozens of TXGR PAC endorsed candidates that defeated Anti-2A RINOS this past primary.

Texas gun rights President Chris McNutt had this to say "I would like to thank Attorney General Ken Paxton for being willing to take on this fight and the dozens of state legislators that aided and supported Attorney General Paxton in this fight,"

The assault weapons ban trial continues at the Federal Courthouse in East St. Louis and a firearms expert testified Wednesday that the weapons restricted under Illinois assault weapons ban include many of the most common firearms that American consumers use for self-defense.

Steven Randall Watt, a combat veteran and retired law enforcement officer who now owns a private firearms training company, also said he personally owns many types of weapons restricted by the law, as well as large-capacity magazines that he said are an important element in self-defense.

Watt said he subscribes to the adage that says, You never know how much ammunition youre going to need, so you want to keep as much as possible.

The federal judge overseeing a trial challenging Illinois assault weapons ban wondered aloud from the bench on Thursday whether the guns currently outlawed by the state might have prevented the 1917 race riots in East St. Louis - had they existed and been legal at the time.

Judge Stephen McGlynn made the comments at the end of the four-day bench trial, one of several remarks he made during the trial about the value of AR-15-style guns as tools for civilian self-defense. McGlynn said he plans to rule on whether or not the law is unconstitutional in about a month.

Ghost guns are privately made firearms that lack serial numbers and are manufactured without regulatory oversight. These weapons can be created by assembling components from kits or by 3D-printing parts from scratch. This makes them virtually impossible for authorities to trace, bypassing traditional gun control measures and allowing for the sale or manufacture of firearms without a license.
