A Washtenaw County judge Wednesday dismissed a lawsuit against Ann Arbor Public Schools that claimed its policies banning guns break state law.
Michigan Gun Owners in April filed a lawsuit against the district, which had enacted policies that effectively ban guns from schools.
Washtenaw County Circuit Court Judge Carol Kuhnke on Wednesday, Sept. 23 granted the district's motion for summary disposition, thereby dismissing the lawsuit.
Jim Makowski, the attorney for Michigan Gun Owners, said he will appeal the ruling.
A Genesee County judge ruled earlier this year a father can carry a gun into schools as state law does not ban concealed pistol license holders from openly carrying in schools. |

The mother of a trooper who was accidentally shot and killed by a firearms instructor has filed a wrongful death lawsuit.
David Kedra's mother is seeking compensatory damages from Richard Schroeter. The lawsuit claims that Schroeter recklessly ignored firearm safety rules during a weapons demonstration last September.
Kedra died after he was accidentally shot in the stomach.
Schroeter pleaded guilty to five counts of reckless endangerment. He was sentenced to two weeks behind bars and 18 months of house arrest.
Submitters note: The article doesn't mention that Schroeter was a Pennsylvania State Cop when he shot Kendra.
Following the cardinal rules of gun safety would have prevented this. |

State Sen. Rob Bradley stepped forward on Wednesday and sponsored the Senate companion bill to a proposal by state Rep. Dennis Baxley, father of the state�s controversial �Stand Your Ground� law.
Bradley � an Orange Park Republican and former state prosecutor � lent his name to Baxley�s cause of tweaking state law to boost the legal standing of defendants who claim they acted in self-defense while using or threatening to use deadly force in a dispute. |

Of particular concern is the exclusive focus on firearm-related homicides. Both elements contained in this compound term are extremely problematic. First, a decline in the percentage of killings committed with guns is meaningless when there is a corresponding increase in the percentage committed with knives and other weapons. The same number of people are dying. Knife crime in London has increased since the handgun ban in England and Wales went into effect�why would Australia be any different?
In fact, it�s not. Statistics show a definite upward trend for knife crime in Australia. If the only thing the confiscation changed is what kind of weapon you�re most likely to be murdered with, this is a hollow victory indeed. |

A University of Missouri associate law professor has filed a lawsuit contending that the school�s ban on concealed weapons on campus violates his constitutional rights.
The lawsuit filed Saturday by Royce de R. Barondes against the Board of Curators and President Tim Wolfe also argues the ban conflicts with a state law that allows guns to be stored in the passenger compartment of a vehicle by an adult with a permit.
His attorney, Jennifer Bukowsky, also argues the ban violate Barondes� right to keep and carry weapons on campus for self-defense. Barondes is licensed to carry a concealed firearm. |

The U.S. Supreme Court ruled seven years ago in District of Columbia vs. Heller that the 2nd Amendment "conferred an individual right to keep and bear arms," but it also said that right was "not unlimited." Government and courts have been wrestling ever since over just how far an individual's right goes, and a decision Friday by the U.S. Court of Appeals for the District of Columbia Circuit may help draw some much-needed boundaries. |

A concealed carry permit holder in Warren, Michigan, found himself face to face with a bank robber and shot the man three times.
The permit holder, Ruben Kendrick, encountered the alleged armed robber Monday afternoon as the gunman was leaving the Citizens Bank near 9 Mile with $11,000 in cash garnered from the tellers.
Upon threatening the permit holder, the robber, Henry Mann, 43, picked up three gunshots from the citizen, as reported by the Detroit Free Press. |

The freshman senator � who noted both parties �have distinct differences but we respect those differences� � praised GOP work in the upper chamber to scrap the two-thirds rule requiring 21 senators to agree before a bill could go to the floor for debate. They instead required three-fifths, or 19 senators, to agree. �The Senate got a lot of legislation passed and that is why,� she said. She praised funding for border security and talked about her policy to prevent taxpayer-funded lobbyists from talking to her office. And unlike Collier, she said she�s very glad the legislature took action on open carry and campus carry. |

Although it may sound surprising, gun control organizations and those in favor of gun reform legislation, should use all efforts to convince the Supreme Court to review this case. On Friday, September 11th, a federal court in Boston ruled that the Second Amendment rights of plaintiff Steve Richmond were infringed when he was denied a license to carry by Hingham Police Chief Michael Peraino due to a 40 year old conviction for possession of marijuana.
In denying Richmond�s license application, Chief Peraino relied upon a state law that bars anyone convicted of �any law regulating the use, possession or sale of a controlled substance� from obtaining a license to possess, purchase, or carry firearms. |

A Little Torch Key man tried breaking into a Big Pine Key house Tuesday night but was shot dead by the homeowner.
The Monroe County Sheriff�s Office reports that Andrew Grzych, 29, died on the porch of the Oleander Boulevard home he was breaking into around 11 p.m. He was shot by the homeowner, Patrick Wunsch, 31, who was armed with a semi-automatic Glock pistol, said Sheriff�s Office spokeswoman Deputy Becky Herrin.
Wunsch was not arrested and the State Attorney�s Office has not pressed charges. Herrin said the investigation is ongoing, but this could be a case of self defense.

A Winston-Salem man has been stabbed to death after police say he broke into his ex-girlfriend's apartment.
Police told local media that 32-year-old Michael Joyner died after he had been stabbed several times Tuesday morning.
Officers responding to a call found Joyner inside with several stab wounds. He was taken to Wake Forest Baptist Medical Center where he died. |

A 63-year-old autoworker with a concealed weapons license was being questioned by police Monday evening after he shot a gunman allegedly robbing a Warren bank but is not expected to face criminal charges, according to city officials.
The 43-year-old gunman suffered three non-fatal gunshot wounds as he confronted the autoworker in the lobby of Citizens Bank on Van Dyke Avenue north of Nine Mile Road.

The head Bald Knob cop trying to run open carry advocates out of town resigned Monday, citing fears for his family�s safety after his truck was torched and vandalized in front of his home last week; the phrase �2 Amendment� spray painted on both sides.
But some Arkansas residents believe Erek Balentine may have faked the incident as a way save face over his rigid stance against open carrying guns in public � a view that contradicted state law � putting the town of Bald Knob at a liability risk.
In fact, it was only last weekend that we reported that two men who were open carrying were detained and handcuffed for taking pictures of the Bald Knob Police Department. |

A new Rasmussen poll released today says that a majority of American voters are opposed to the federal government being the final authority on who can own guns.
This comes on the heels of a Gallup survey, discussed earlier by this column, that shows nearly half of Americans think the federal government is a threat to their liberty. The new Rasmussen poll was taken with 1,000 likely voters Sept. 20-21.
According to Rasmussen, only 34 percent of likely voters think the federal government should have responsibility for gun laws, while 36 percent think this is a state government responsibility. Eighteen percent believe local government should have that authority, and 12 percent were not sure, the poll said. |

A Missouri woman is in critical condition and fighting for her life right now because she pulled a gun to use it as a warning.
...
Far too many people don�t seem to understand that merely owning a gun isn�t going to protect you. It isn�t a magic talisman or amulet other magical item. A gun is a tool, and it only functions properly if you have the mindset and skills to use it.

The Los Angeles Times editorial board is upset.
They don�t like the U.S. Supreme Court�s 2008 decision in District of Columbia vs Heller, and are furious that an appellate court�s mixed response in what has been dubbed �Heller III� struck down four of the ten gun laws challenged.
They clearly prefer their fantasy version of the Second Amendment. |
