U.S. Rep Marc Molinaro criticized Tuesday New York states concealed carry gun laws as an infringement on constitutional rights.
Molinaro, R-Catskill, responded to Gov. Kathy Hochuls pledge in a posting on X, formerly Twitter, to keep the Concealed Carry Improvement Act in place.
Justice Clarence Thomas just granted a request for an emergency conference in a case trying to dismantle our concealed carry law, Hochul said on X. I know the far-right is focused on placating the MAGA extremists. Im focused on protecting New Yorkers.
But Molinaro, who represents the 19th Congressional District, said the law, known as Concealed Carry Improvement Act, was wrong.
Your law is unconstitutional, Molinaro responded on Tuesday night. |

A Georgia homeowner shot an early morning intruder twice to defend himself and his family; the intruder is suspected of having fatally stabbed a 77-year-old woman.
A homeowner in Fayette Country, GA, was home with his family on the morning of Sept. 14. He heard what sounded like an intruder in their basement, so he called the police to report the break-in and armed himself with a handgun.
He confronted the intruder in the basement and found that he was armed with a knife. He warned the intruder and fired one shot, hitting the armed intruder. The homeowner then retreated to the top of the basement stairs to protect his family on the second floor. |

Except, Scheu asked himself, what if there were staff members trained to intervene? What if a handful of teachers, aides, and others could quickly reach for a firearm if an active shooter were targeting students?
When youre talking about putting out an active shooter threat, its a matter of seconds, not a matter of minutes, said Scheu, who has served as superintendent in the district since July 2020. And its a matter of life and death. |

If youre wondering What are the basic parts of ammunition?and if you got here via Google then you probably arethen let us break it down for you. The four fundamental components of all types of ammo are the case, the primer, the powder, and the projectile. When assembled together, they make up a rifle or pistol cartridge or a shotgun shell. All are examples of self-contained ammunition, which has been with us for well over a century. Using these four parts, ammunition is either made by factories or handloaders, and though the make-up and design of the basic parts have evolved and continue to do so, their overall function and how they work together have not. Heres a full breakdown of the basic parts of ammunition. |

Kris Brown, president of Brady United Against Gun Violence, knows that the stakes are high. Having dedicated her career to curbing gun violence, she is familiar with the way firearm access exacerbates domestic violencewhat she calls a uniquely American crisis. But she is not hopeless.
Last week, Brown spoke with Ms. to help readers understand how we should be thinking about U.S. v. Rahimi, the way she approaches the link between intimate partner violence and gun violence, and where she finds her optimism. |

The future of one of the toughest gun control laws in the nation could be determined within the next couple of months.
Lawyers this week finished making their arguments in the state trial surrounding Measure 114, which voters narrowly passed in November.
Harney County Circuit Court Judge Robert S. Raschio, who put the implementation of the measure on hold while the court case advanced, will have 60 days to decide whether the measure violates the state constitution and if it should ever go into effect. |

Sweeping new gun laws take effect this weekend, including a ban on openly carrying handguns, new "safe storage" requirements, stricter rules for firearms dealers and a limit of three handgun purchases per month. Larger city police chiefs pushed for the cap. "There's too many people on these 'straw purchases,'" said Waterbury Mayor Neil O'Leary on Jan. 23. "'Straw purchases' meaning they come in, they buy a dozen guns for, say, $500 a gun and then they sell them on the street for $1,500." The new restrictions are part of a sweeping gun control package pushed by Gov. Ned Lamont. |

How many times will it take for Gov. Gavin Newsom, Attorney General Rob Bonta and others to realize Californias gun laws must follow the Second Amendment to the Constitution of the United States of America?
On Sept. 22, their attempt to limit rifle and pistol magazines to 10 bullets again was shot down by Judge Roger Benitez of the Southern District of the U.S. District Court, part of the Ninth Circuit. The ban derived from Proposition 63 in 2016. |

Senate Bill 2 by Senator Anthony Portantinos (DBurbank), which is Californias response bill to New York Rifle and Pistol Association v. Bruen, was signed into law Tuesday. SB 2 enacts numerous sensitive locations where guns are banned, and changes requirements to obtain a concealed carry license. SB 2 was also sponsored by Gov. Gavin Newsom and Attorney General Rob Bonta, and simply put illegally imposes restrictions on those seeking a California Concealed Carry Weapons (CCW) permit.
Notably, Newsom, Bonta and Portantino know they are imposing restrictions to those applying for CCWs, when virtually no crimes are committed by CCW holders, who are required to pass background checks by County Sheriffs, and take gun safety courses. |

To us, the jurys verdicts resolved this case as fairly as possible, holding the Staffords accountable for going too far in their self-defense, while recognizing their natural response to defend themselves.
We wonder how any of us would respond to the Liming groups actions, especially in a time where random shootings with real guns are far too common and Stand Your Ground is part of our laws. Were grateful the outcome was not even worse.
With eight of 12 jurors against convicting Deshawn Stafford of involuntary manslaughter, we dont see what would be gained by prosecutors seeking a second trial on that lone charge. His life is already forever changed with a felony conviction. |

Far-left Democrats have long pushed for overreaching and unconstitutional gun control legislation. Frustrated with the Second Amendment to the United States Constitution, Californias Democrat Governor Gavin Newsom is proposing a constitutional amendment that would effectively repeal the right to keep and bear arms.
Newsoms 28th amendment petition has many hoops to jump through before becoming a reality. This would need to be approved by 2/3rds of both houses of Congress and then be ratified by 3/4ths of state legislatures. |

Another major gun rights dispute is coming to the justices as they are poised to decide whether a 1994 federal law that bars people under domestic violence restraining orders from possessing firearms violates the U.S. Constitution's Second Amendment. President Joe Biden's administration appealed a lower court's ruling that the law ran afoul of the Second Amendment's "right to keep and bear arms" because it fell outside "our nation's historical tradition of firearm regulation." A challenge to the law was filed by a Texas man charged with illegal gun possession while subject to a domestic violence restraining order after assaulting his girlfriend. Arguments are scheduled for Nov. 7. |

The outcomes of several lawsuits aiming to broaden where gun owners can carry their weapons could hinge on how the US Supreme Court decides an upcoming case about the rights of domestic abusers.
The high court in June agreed to hear the case of Zackey Rahimi, who argues his Second Amendment rights were violated by a law that prohibits an individual under a domestic violence restraining order from owning a firearm.
When the Supreme Court rules on Rahimis case, it will be the courts first opportunity to clarify its decision in New York State Rifle & Pistol Assn v. Bruen, a 2022 case that sent shockwaves through the lower courts over how it instructed judges to adjudicate challenges to gun laws. |

The U.S. Supreme Court on Monday kicks off a new nine-month term featuring major cases ranging from the right of domestic abusers to have guns to the fate of the federal consumer finance watchdog agency, giving its muscular conservative majority fresh opportunities to reshape American law.
Its docket features tests of the authority of U.S. agencies including an effort to effectively dismantle the Consumer Financial Protection Bureau (CFPB) and limit the in-house enforcement proceedings of the Securities and Exchange Commission (SEC), the financial markets regulator. |

New York states rule requiring background checks for ammunition purchases will be scrutinized by the U.S. Supreme Court.
On Tuesday, Justice Clarence Thomas granted a request for an emergency conference of the court to evaluate the new regulations.
The law now requires background checks on all ammo purchases and the payment of a $2.50 fee.
In response, Governor Kathy Hochul criticized Justice Thomas and said his decision is an attempt to placate conservative big donors.
Republican lawmakers who represent parts of the tri-county region are applauding Thomas. |

I enjoy disparate interests. I teach Second Amendment law, and teach and write a treatise on advertising law. I was surprised that two of my legal interests coincided when Illinois House Bill 218 was signed into law by the Illinois Gov, J.B. Pritzker.
H.B. 218 is an omnibus gun safety law, and one of its prohibitions is the advertising of a gun in a way that may support, recommend or encourage a person under 18 to unlawfully purchase, possess or use a firearm in Illinois. In addition to the vagueness of this criminal statute, it has First Amendment problems. Maybe Second Amendment issues, too. |

California has a gun and ammo tax now that Gov. Gavin Newsom signed several new gun control measures. One piece of legislation, California SB2, bans the carrying of firearms in most public places within the state. Another measure, AB 28, doubles the tax on guns and ammunition purchased in California. The move (Newsom signed nearly two dozen gun control measures in one day) has stirred debate and makes California the only state to add a separate excise tax on ammunition and firearms. |

Dont worry America, the B-Team is here. Gun violence will soon be gone like affordable gas thanks to President Bidens formation of the Office of Gun Violence Prevention.
Although the official White House press release announcing the new federal office doesnt say how it will accomplish its goals, it lists them. They include:
Banning assault weapons and high-capacity magazines; Requiring safe storage of firearms; Requiring background checks for all gun sales; Eliminating gun manufacturers immunity from liability. |
