A burglar who was shot dead after breaking into a West Point Loma Boulevard apartment last month has been identified as Johnnie Curtis Smith Jr. III, 35, of Mountain View, the Medical Examiner's Office said yesterday. Police say Smith and an accomplice broke into an apartment near Dog Beach the night of Aug. 20 while a man was asleep on the couch. The occupant, who was struck on the head with an object, then got into a struggle with one of the intruders over the intruder's gun, which went off during the fight.
Smith was taken to the hospital, where he died. His accomplice fled and has not been caught.
Police found the occupant outside the home, bleeding from a head wound.
Nothing was taken during the robbery attempt, police said.
Police determined the resident acted in self-defense and will not be arrested.
