NY: Jewish Group to Sue New York for Banning Guns in Houses of Worship

The New York State Jewish Gun Club plans to sue New York for banning firearms in places of worship, calling it �unconstitutional� in an interview with the Daily Caller News Foundation.

Tzvi Waldman, the founder of the New York State Jewish Gun Club, is working with a civil rights attorney to challenge a provision of New York�s new Concealed Carry Improvement Act, prohibiting congregants from carrying guns inside places of worship among other locations it deems �sensitive.�

In August, the Department of Justice urged a federal court to dismiss the lawsuit broughy by Florida's Agriculture Minister Nikki Fried, which seeks to allow legal medical marijuana users to buy and own guns. The government argued that it was �dangerous to trust regular marijuana users to exercise sound judgment.�

The DOJ cited offensive "parallels to past gun prohibitions for groups such as Native Americans, Catholics, panhandlers, as well as those who refuse to take an oath of allegiance to the government and people who shoot firearms while drunk."

A Jacksonville man died Saturday in a stabbing incident and the district attorney's office has ruled it self-defense.

Onslow County Sheriff's Office deputies responded to 570 Huffmantown Road in Richlands at 7:48 p.m. on Saturday in reference to a man trespassing and attempting to enter the home, according to a news release from OCSO Thursday afternoon.

The release said Samuel Richards II, who lives at the home, but was not there at the time, called 911 for his girlfriend Kelsey Cavenaugh, who was at the residence and witnessed the suspect, Grant Taylor, attempting to enter the home without permission.

In her 1892 pamphlet Southern Horrors: Lynch Law in All Its Phases, the journalist Ida B. Wells argued that firearms were an essential tool in preventing the deadly white supremacist violence that she chronicled. "Of the many inhuman outrages of this present year, the only case where the proposed lynching did not occur, was where the men armed themselves in Jacksonville, Fla., and Paducah, Ky, and prevented it," she wrote. "The only times an Afro-American who was assaulted got away has been when he had a gun and used it in self-defense."

Though US District Judge Glenn T. Suddaby denied a request last week to stop the law from taking effect, his 78-page decision described at length why the law could be found unconstitutional.

Among his reasons:

The new law omitted the phrase �other than in self-defense,� which could create a Second Amendment problem;
The state�s list of �sensitive places� is extensive, and automatically declaring private property a restricted location usurps private property rights;
The law�s social media and character reference requirements grant too much discretion to licensing officers and risk punishment for political speech in violation of the First Amendment;

A first degree premeditated murder charges has been dismissed against a woman accused in the shooting death of her daughter�s boyfriend in 2021.

Dawn Sluder was released from the Escambia County Jail where she had been held since February 2021.

The dismissal cam after Jonathon Taylor Hobbs of Cantonment walked out of the Escambia County Jail Saturday a free man, following his acquittal on a first-degree premeditated murder.

Hobbs, 29 was accused of the shooting death of 35-year old Danny Blackmon, Jr., on February 1, 2021. He would have faced up to life in prison if the jury had convicted him.

Attorney Andrew Branca, whose opinions often appear on William Jacobson's blog Legal Insurrection, has proposed what he calls Kyle's Law due to what he and I both regard as a politically motivated prosecution of Kyle Rittenhouse for what was obviously self-defense.

"Too often, rogue prosecutors bring felony criminal charges against people who were clearly doing nothing more than defending themselves, their families, or others from violent criminal attack. �The only motivation of the prosecutor is personal aggrandizement and political capital."

With the primary now behind her, U.S. Rep. Shelia Cherfilus-McCormick, D-Fla., is running for a full term in her own right and is showcasing her support for gun control proposals.

Cherfilus-McCormick replaced longtime U.S. Rep. Alcee Hastings, D-Fla.. who died in April 2021. In the special election held at the start of the year, she took 79 percent of the vote while Republican Jason Mariner got 19 percent, Libertarian Mike ter Maat garnered 1 percent and two candidates�Jim Flynn and Lenny Serratore�who were both running with no party affiliation�each pulled around .5 percent.

Per the Biden-Harris Administration�s new rule, the updated form that pistol owners will now have to complete to register their pistol brace firearm is the ATF Form 1.

According to the ATF itself, completing a Form 1 takes approximately four hours.

That means, the owners of up to 40,000,000 braced weapons will spend up to a collective 160,000,000 hours registering their lawfully acquired firearms to comply with the Biden-Harris Administration�s new regulation.

In the lawsuits, the gun rights group rejects the use of the term �assault weapon,� calling it a �charged political term meant to stir the emotions of the public� and instead uses the term �banned firearm.�

The lawsuits allege that the bans violate the Second Amendment of the U.S. Constitution. They cite recent U.S. Supreme Court decisions, including a 2008 decision overturning Washington D.C.�s ban on handguns, a 2010 decision overturning similar handgun bans in Chicago and Oak Park, and a decision from June of this year overturning the state of New York�s law requiring people to show �proper cause� for obtaining a firearm license.

Polls show there is strong support for gun safety measures.

Seventy-two percent of voters surveyed in a recent Journal Poll said they support increasing the minimum age to buy an AR-15 style semi-automatic rifle from 18 to 21. Slightly more, 73%, said they support making it a crime to fail to safely secure firearms from children.

Those numbers shouldn�t be surprising after a string of deadly mass shootings across the nation and record-setting homicides in the Metro. What may be surprising is the support among Republicans, who have typically opposed just about any gun control measures.

Let's face it: The vast majority of us don't have time to go to the range as often as we'd like, and most of us can't afford to feed our concealed-carry pistols a case of ammunition at a time. Dry practice and laser training can really help bridge the "training gap," but in the end there's no substitute for the real operation of a firearm. The Naperville lawsuit says the city�s ordinance violates the Second Amendment rights of association members who live in the city because it prohibits them from buying �banned firearms� at stores in Naperville.

�The city�s regulation is not consistent with the nation�s history and tradition of firearm regulation,� the suit says.

It goes on to say the ordinance�s prohibitions extend to Bevis and his customers, �where Second Amendment protections are at their zenith, as it burdens their right to acquire arms for the defense of their home.�

Beyond overturning the ordinance, the suit seeks attorney costs, and compensatory damages.

At least 15 people signed forms relinquishing their Second Amendment rights after the FBI presented them, Kaminsky reported. Gun Owners of America obtained the forms through the Freedom of Information Act (FOIA) and provided them to the DCNF.

�Obviously, we spoke to a lot of legal experts and a lot of gun experts, including people at Gun Owners of America and lawyers who have worked lot with these groups and are very familiar with these groups, who were unsure of the legality of how this bodes for not only the Second Amendment, but other statutes of U.S. code,� Kaminsky said.

Groups challenging the ban, including the Firearm Policy Coalition, have opposed the remand, claiming that the previous decision determined their claims' success and the Supreme Court decision doesn't change the analysis.

California Attorney General Rob Bonta, meanwhile, said in a statement that he looks forward to "defending this law in the district court to protect the public safety of Californians and so that they can safely live, work, and congregate without fear of becoming a victim of gun violence."

A national gun policy group amended its complaint against the state of Tennessee seeking to allow those between 18 and 20 to openly carry firearms.

The amendment comes after the Firearms Policy Coalition won a similar case in Texas in late August.

"The State cannot carry its burden of proving the existence of 'a distinctly similar historical regulation' that burdened the right to bear arms in the same way and for the same reasons," argues the complaint. "Instead, the relevant historical evidence weighs heavily in favor of upholding the right to carry loaded handguns in public for 18-to-20-year-olds, just the same as for those who are 21 years and older.
